1. Who we are and what these terms cover. These Terms and Conditions are a binding agreement between you and BriTer Eyez, LLC, the maker of MoistureVue™ (“MoistureVue,” “we,” “us”). They govern your use of moisturevue.com (the “Site”) and your purchase and use of our products. By using the Site or placing an order, you agree to these Terms, our Privacy Policy, and our Returns and Refunds Policy, which are part of this agreement. If you do not agree, please do not use the Site.

2. Eligibility. You must be at least 18 years old to make a purchase or create an account. By ordering, you confirm that you are 18 or older.

3. Our products are wellness products. MoistureVue™ is a wellness product manufactured and distributed by BriTer Eyez, LLC. Statements regarding MoistureVue have not been evaluated by the U.S. Food and Drug Administration. This product is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, including dry eye disease (keratoconjunctivitis sicca) or any other ocular condition. Information provided on this Site and in associated materials is for general wellness and informational purposes only and does not constitute medical advice or a recommendation for any specific medical treatment.

4. Site content is not medical advice. The content provided by MoistureVue and BriTer Eyez, LLC, including without limitation website articles, emails, guides, quizzes, podcasts, videos, social media posts, and community discussion, is for general informational and wellness purposes only. It is not medical advice, does not establish a doctor-patient relationship, and is not a substitute for professional diagnosis, treatment, or care. Always seek the advice of a qualified eye care professional or physician with any questions you may have regarding your eyes or any medical condition. Never disregard or delay seeking professional medical advice because of information obtained from MoistureVue.

5. Proper use and safety. MoistureVue is designed to attach to your existing glasses frames and is intended for stationary or low-activity use. By using the product, you agree to the following:

• Follow the step-by-step instructions for use (IFU) included in every box, including the cleaning and care guidance.
• Keep the product clean, and do not use a unit that is damaged, torn, or visibly worn.
• Do not use the product if you have an active eye infection, a recent eye injury, or recent eye surgery, unless your eye care professional says otherwise.
• Do not use the product while driving, biking, riding a motorcycle, or operating machinery, or during any activity requiring unobstructed vision or rapid visual response.
• Discontinue use immediately if you experience any change in vision, eye discomfort, irritation, pain, or redness, and consult an eye care professional.

You understand that comfort and fit vary by individual, and you assume responsibility for using the product as directed.

6. Orders, payment, and pricing. All orders are subject to availability and confirmation of payment. Prices and any discounts are as displayed at checkout at the time of purchase. We reserve the right to refuse or cancel any order, limit quantities, correct pricing errors, and modify or discontinue products. If we cancel an order after you have been charged, we will refund the full amount.

7. Subscriptions and automatic renewal. If you purchase a MoistureVue subscription:

• Your subscription renews automatically each month, and your payment method will be charged the subscription price shown at checkout, plus any applicable taxes, on a recurring monthly basis until you cancel.
• You can cancel at any time through your account on our website or by emailing support@moisturevue.com. Cancellation takes effect at the end of your current billing period, and you will not be charged again after that. You will keep your final shipment; no partial refunds are issued for the remainder of a billing period, except as provided in our 30-day guarantee.
• We will send you an order confirmation with these renewal terms after your first purchase, and we will notify you by email in advance of any change to your subscription price.

8. Shipping. Shipping times are estimates and may vary based on location, carrier, and external factors. We are not responsible for delays caused by carriers, packages lost or stolen after confirmed delivery, or incorrect shipping information provided by the customer. If your order arrives damaged, contact us and we will make it right; see our Returns and Refunds Policy.

9. Returns and refunds. Purchases are covered by our 30-day guarantee. The full policy, including how to start a return, is in our Returns and Refunds Policy, which is part of these Terms.

10. Intellectual property. All content on the Site, including text, images, graphics, logos, product design, and the underlying code, is the property of BriTer Eyez, LLC or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws. We grant you a limited, revocable, non-exclusive license to access the Site for personal, non-commercial use. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission. Patent and trademark notices are on our Intellectual Property page.

11. Customer stories and reviews. Customer testimonials, reviews, and stories presented by MoistureVue reflect the individual experiences of the persons providing them and are not necessarily representative of the experiences of all users. Results and comfort levels vary based on factors including but not limited to product fit, individual physiology, environmental conditions, and consistency of use. MoistureVue does not guarantee specific outcomes.

12. Content you submit. If you post or submit content to the Site or our community spaces (such as comments, reviews, ratings, or photos), it reflects your views, not ours. You grant BriTer Eyez, LLC a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with our business, consistent with our Privacy Policy and, for testimonials, only with the permission practices described there. We do not verify and are not responsible for user-generated content, and we reserve the right to moderate, edit, or remove it at our discretion. Community content is not medical advice.

13. Third-party links and services. The Site may link to third-party websites or content, including scientific references. We provide these for convenience and do not endorse or control them. If we ever use affiliate links, we will disclose that clearly where the links appear.

14. Forward-looking statements. Certain statements on the Site, including statements regarding planned product launches, FDA registration timelines, partnership development, and business plans, are forward-looking. They reflect current expectations and assumptions and are subject to risks, uncertainties, and changes in circumstances. Actual outcomes may differ. We undertake no obligation to update forward-looking statements except as required by law.

15. Disclaimer of warranties. The Site and our products are provided “as is” and “as available.” To the fullest extent permitted by law, BriTer Eyez, LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the product will fit every glasses frame or suit every user. Some states do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Nothing in these Terms limits any warranty or right that cannot be limited under applicable law, including your rights under our 30-day guarantee.

16. Limitation of liability. To the fullest extent permitted by law, BriTer Eyez, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for damages arising from improper use of the product, use contrary to the instructions for use or Section 5 above, or compatibility issues with specific eyewear. To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the product is limited to the amount you paid for the product giving rise to the claim. Some states do not allow certain limitations of liability, so some of the above limitations may not apply to you.

17. Indemnification. You agree to indemnify and hold harmless BriTer Eyez, LLC and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site or products.

18. Governing law and disputes. These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms, the Site, or our products will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction.

19. Changes to these Terms. We may update these Terms from time to time. The current version will always be posted on this page with its effective date. If we make material changes to subscription or billing terms, we will notify active subscribers by email before the changes take effect.

20. Severability and entire agreement. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy and the Returns and Refunds Policy, are the entire agreement between you and BriTer Eyez, LLC regarding the Site and our products.
